Trademark Registration TM I
A trademark is any sign that distinguishes one business's goods or services from another's: a brand name, logo, slogan, shape, colour combination, or even a sound. It's the legal handle on your reputation — the thing customers recognise before they read a single word of your marketing. Registration turns that informal recognition into an enforceable right. While unregistered marks can attract limited protection through "passing off" claims, a registered trademark gives you:
Exclusive rights to use the mark for the goods/services in your registered classes Legal presumption of ownership, so you don't have to prove reputation from scratch in a dispute A basis to block later, confusingly similar applications and to act against infringers A business asset you can license, franchise, or sell Deterrence — the ® symbol discourages copycats before litigation is needed
Marks are registered under the Nice Classification, which sorts goods and services into 45 classes; protection extends only to the classes you file in. Rights are also territorial, so a registration in one country doesn't automatically protect you elsewhere. In Pakistan, applications go through the Intellectual Property Organization (IPO-Pakistan) Trademarks Registry under the Trade Marks Ordinance, 2001, with registration valid for 10 years and renewable indefinitely.
